Forever 21 Slaps Gucci with a Trademark Lawsuit Before Gucci can Get Them!

Forever 21 has become infamous for infringing on major brands’ trademarks. This time GUCCI has been flirting with the idea of hitting Forever 21 with a suit for using their blue, red, blue and green, red, green stripe combination which they have trademarked. And lets face it, if you know GUCCI you know they have been using those classic stripe series for decades. This suit would have joined some other pending accusations, but it seems the brand has beat them to the punch.

Gucci and Forever 21 have had issues in the past, so this time they have decided to strike first. They argues that the stripe combinations are too general and simple to be claimed by GUCCI alone. They are fighting to have the cease and desist orders filed against them for the stripe combos and around nine other trademarks dropped. However, with such a muddied past when it comes to these copyright suits it is hard to see how the fast fashion giant can be revered even if the stripe combinations are ambiguous. A representative from GUCCI told The Fashion Law“Forever 21’s reputation for being accused of profiting from the trademarks and copyrights of others, including Gucci, is well established.”

Do you see the resemblance? Are they copying, or is GUCCI splitting hairs?
